Mayor's Permit: One Form, and the 20-Day Limit

Most of what makes a mayor’s permit difficult was made unlawful in 2018. RA 11032, the Ease of Doing Business Act, rewrote the process, and the parts worth knowing are the ones that run in your favour when the office is slow.

The clock, and what happens when it runs out

The period runs from the date your complete application was received. It may be extended once, for the same number of days, and only with written notice given before the original period lapses, stating the reason and the final release date. You sign that notice as proof you received it.

Then the provision that matters most:

If the office fails to approve or disapprove the application within the prescribed processing time, the application is deemed approved.

The conditions are that you submitted all required documents and paid all required fees. Your acknowledgement receipt plus the official receipt then has the same force and effect as the permit. For a renewal, the existing permit is automatically extended instead.

This is why the acknowledgement receipt is worth keeping. It is not a stub, it is the evidence that starts the clock.

One form, not a tour of the building

RA 11032 requires a single unified business application form for both new applications and renewals, consolidating what used to be separate errands:

It further provides that other local clearances, sanitary permits and environmental and agricultural clearances, shall be issued together with the business permit. They are outputs of the same application, not separate queues.

The Business One Stop Shop is the single site, or single portal, where this happens. It sits inside the city or municipality’s Negosyo Center under RA 10644, with a queuing mechanism and the treasury, licensing, zoning and BFP offices co-located.

Fire clearances have their own cap: a Fire Safety Evaluation Clearance and a Fire Safety Inspection Certificate shall in no case take longer than 7 working days.

The barangay step moved

This one still surprises people. Under Section 152(c) of the Local Government Code, no city or municipality could issue a business permit unless a barangay clearance was obtained first, and the barangay had 7 working days to act, after which the city could issue the permit anyway.

RA 11032 amended that. Barangay clearances related to doing business are now applied for, issued and collected at the city or municipality, with the barangay’s share of the collection remitted to it afterwards.

What it costs, and why no page can tell you

Section 147 lets a municipality impose reasonable fees on business and occupation commensurate with the cost of regulation, inspection and licensing. That is a standard, not an amount. Each LGU sets its own by ordinance, so the permit fee genuinely differs across roughly 1,600 cities and municipalities.

What is national is the business tax in Section 143, computed on your gross sales or receipts for the preceding calendar year. For manufacturers and similar businesses the statutory schedule runs:

Above ₱6,500,000.00 the schedule stops being a fixed amount and becomes a rate, which is 0.375% of gross sales expressed the long way.

Dealers in essential commodities, including rice and corn, meat, dairy, sugar, salt, cooking oil and gas, laundry soap, detergents, medicine, fertilizers and agricultural implements, are taxed at a rate not exceeding one-half of those rates.

A very small business may not need this schedule at all. A BMBE registration exempts the enterprise from income tax, and LGUs are encouraged to reduce or waive local taxes and charges for it.

Validity and renewal

The permit is valid for one (1) year. The LGU may run renewals either within the first month of the year or on the anniversary date of issuance, and which of the two applies is a local choice.

Where this goes wrong

Queueing separately for the sanitary and zoning clearances. The law requires them to be issued together with the permit, off one form.

Going to the barangay first for a business clearance. That step now happens at the city or municipality.

Throwing away the acknowledgement receipt. With the official receipt it is what proves automatic approval if the deadline passes.

Assuming the clock started when you first enquired. It starts when the complete application is received.

Expecting a national permit fee. Section 147 sets a standard, not an amount, and each LGU legislates its own.

Computing the business tax on this year’s sales. Section 143 uses the gross sales or receipts of the preceding calendar year.

What happens to an official who refuses to accept my application?
Section 21 lists it as a prohibited act, alongside failing to issue official receipts and colluding with fixers. A first offense carries administrative liability with 6 months suspension. A second carries dismissal, perpetual disqualification from public office, forfeiture of retirement benefits, imprisonment of 1 to 6 years and a fine of ₱500,000.00 to ₱2,000,000.00.
