What this calculator does

PD 851 sets the minimum at one twelfth (1/12) of the total basic salary earned within a calendar year. Two words decide most disputes: basic and earned.

A full year at a steady salary produces exactly one month’s pay. That is a consequence of the formula, not the rule itself, which is why an incomplete year does not produce a full month.

There is no minimum length of service in the formula itself: 1 month worked earns 1/12 of 1 month’s basic.

Earned, not contracted

Unpaid absences reduce the basic salary earned and therefore the 13th month pay. A ₱12,000.00 monthly salary with ₱12,000.00 of unpaid absence across the year is ₱132,000.00 earned, so ₱11,000.00 rather than ₱12,000.00.

Basic, not gross

Basic salary excludes allowances and monetary benefits that are not part of the regular basic pay: unused leave conversions, overtime, premium, night differential and holiday pay are all outside it unless company practice has integrated them.

The deadline

Payment is due on or before 24 December each year. It is a statutory minimum, so a more generous company practice satisfies it and cannot be used to reduce it. Employers report compliance through the DOLE Online Compliance Portal at reports.dole.gov.ph, which the current advisory sets at not later than 15 January 2026, covering 8 items including total employment and the amount granted per employee.
